RENT A MOTORHOME NI TERMS AND CONDITIONS

Definitions

‘I’, ‘me’, ‘my’, ‘we’, ‘you’, ‘yours’, ‘yourself’ and ‘hirer’ refers jointly and severally to the person or persons who are the Customers.

‘Customer’ means the person or persons nominated as the hirer under the heading ‘Hirers Name / Contact’ on the Rental Agreement, any person whose credit or debit card is presented in payment of the Customer’s charges, or any person who deems themselves to be the legal entity and ultimately responsible for the motorhome. Should the legal entity be different from the driver, then full name, address and contact phone numbers must be supplied.

‘This Agreement’ means the Rental Agreement titled Booking Summary and these Terms and Conditions. In the event of any discrepancy between these Terms and Conditions and any other Rent a Motorhome NI literature, the provisions of these Terms and Conditions will apply.

‘Booking’ the confirmed reservation of a motorhome hire and includes the payment of the booking deposit and/ or full balance for the rental.

‘Booking Deposit’ means the monetary amount required to confirm the motorhome booking.

‘Payments’ can be made by bank transfer, debit and/or credit card. We are unable to accept payment by cheque or cash.

‘Rental Period’ means the hire period as stated on the Rental Agreement or any agreed variation thereof and any additional period during which the vehicle is in the Customer’s possession or control.

‘Vehicle’ means the vehicle as stated on the Rental Agreement and includes tyres, tools, accessories, the living equipment and any other special equipment, documents related to the vehicle and any replacement or substitute vehicle which may be provided at the discretion of Rent a Motorhome NI.

‘Living Equipment’ includes, but is not limited to the following: TV & aerial, rear cameras, parking sensors, solar panels, radio, wireless QI charger, oven, crockery, cutlery, cooking utensils and bedding.

‘Security Deposit’ means the amount held as security by Rent a Motorhome NI in relation to this hire.

‘Overhead Damage’ Is deemed as any damage sustained to any part of the vehicle, its equipment and or any third-party property which occurs above 6 feet (1.83 metres) in height measured from the ground upwards.

1. Address

2. Hire rates quoted include:

2.1 Unlimited mileage.

2.2 UK standard Vehicle insurance*.

2.3 UK standard equipment & breakdown** .

2.4 All prices quoted in the Agreement are gross prices including VAT.

2.5 *Insurance loading. In some cases, Rent a Motorhome NI will incur additional charges if the driver to be insured has a traffic conviction, more than 1 insurance claim or is in an occupation which is deemed high risk. These charges will be passed onto the Customer.

2.6 **Rent a Motorhome NI will supply full breakdown cover to cover any mechanical faults to the base chassis of the motorhome. Any call out charges necessitated by the client through operator error, e.g. a flat vehicle battery, wrong or insufficient fuel, keys locked in a motorhome, stuck in mud/sand etc, will be the responsibility of the client.

2.7 A minimum hire charge of 2 nights applies to all bookings, unless otherwise stated.

2.8 A minimum hire term of 5 nights applies in July and August.

2.9 A minimum hire term of 3 nights applies on bank holiday weekends both high and low season.

2.10 Any exception to the minimum hire period or fee is agreed in writing on the Booking Summary.

3. Booking and Payment Details

3.1 Reservations are made online, and will only be confirmed once a Rental Agreement has been completed and a 25% deposit is paid which is non-refundable.

3.2 Reservations made online will be held for 48 hours and confirmed by email on receipt of the deposit or balance payment due.

3.3 Full payment is due four weeks before the collection of the vehicle.

3.4 Rent a Motorhome NI reserves the right to cancel the Booking if payment is not received four weeks prior to departure. Reasonable effort will be made to contact the Customer before any cancellation action is taken.

3.5 Rent a Motorhome NI reserves the right to change the daily rate during key sporting events, other events or promotions.

3.6 Payments can be made by Visa and Mastercard debit or credit card. We are unable to accept payment by cheque or cash.

3.7 All bookings made within four weeks of the hire commencement date must be paid in full at the time of booking.

3.8 Unless expressly stated to the contrary all prices in these terms are inclusive of VAT at the current standard rate.

4. Cancellations and No Show

4.1 We strongly recommend that you take out an appropriate Travel Insurance Policy as soon as possible after booking, to protect your holiday in the case of cancellation.

4.2 Please note that there may be restrictions in any insurance policy to prevent you claiming for any reason relating to Covid-19 and any mutation of or illness associated with the virus. This may mean that you will be liable for the full amount of your booking even though you would be unable to travel or undertake the whole or any part of your stay. By proceeding with your booking, you acknowledge and accept this risk.

4.3 You may cancel your booking up to 7 days prior to pick up date. We will charge a cancellation administration fee of £50.00 for any cancellation. Cancellations made 6 days of less prior to your pickup date will be charged at 50% of the total booking amount, in addition to the cancellation fee.

4.4 To cancel, you must inform us by a clear statement via email to bookings@rentamotorhomeni.co.uk or by using the contact details on the booking form on our website.

4.5 Should the Customer not present themselves on the first day of the Hire Period to collect the motorhome and have not communicated to us prior to this date in writing that they will not be collecting it or intend to collect on an alternative date/time within the booked hire period, this shall be deemed a ‘No Show’.

4.6 Should the hire be deemed a ‘No Show’, the booking will be automatically cancelled at close of business that day and the Vehicle will be released for re-hire.

4.7 All deposits paid are non-refundable.

4.8 No refunds whatsoever will be due for No shows.

4.9 Rent a Motorhome NI reserves the right to cancel the hire if at the commencement of hire the driver/s licenses are invalid or not according to the conditions set out. In these circumstances the total hire charge will be forfeited. Hirers are strongly advised to insure against unavoidable cancellation.

5.14 Belfast Airport Package (£100 per hire)

5.15 Dublin Airport Package (£175 per hire)

6. European Travel

6.1 For those intending to travel into Europe (excluding the Republic of Ireland) there is an additional charge of £100 to cover the European roadside assistance cost. European cover is mandatory, and you will be in breach of these terms and conditions should you take a motorhome into Europe without taking out the additional European cover.

6.2 The following Countries are covered by the European Travel Insurance:

Andorra, Austria, Belgium, Croatia, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Switzerland (including Liechtenstein), Sweden.

6.3 Rent a Motorhome NI must be notified if the hirer intends to leave the island of Ireland in the motorhome. We need to be informed at least 7 days in advance if you are intending to travel outside of Ireland so we can provide written consent for your journey which may be needed at border crossings.

6.4 It is advised that the hirer takes out separate personal accident / travel insurance when travelling outside of the UK and Ireland.

7. Car Parking facilities

7.1 Rent a Motorhome NI allows Customers to leave their vehicle(s) at their own risk on the property driveway for the duration of their motorhome hire subject to the following conditions:

7.2 They do so at their own risk; We may request that your keys are left with us in case we need to move your vehicle in an emergency.

7.3 Rent a Motorhome NI will not be held liable for any theft from the vehicle or damage to the vehicle whilst on our driveway.

8. Vehicle Collection and Return

Collecting your motorhome:

8.1 Motorhome hire periods are as agreed in the Rental Agreement.

8.2 Collection time is usually between 1.00pm and 2.00pm with an agreed collection time identified in your Rental Agreement. An early collection time may be possible and will be charged at a rate of £10 per hour. If you intend to avail of this service, you should choose this option during the booking process.

8.3 Return time is 12.00pm unless otherwise agreed on the Rental Agreement. An later return time may be possible and will be charged at a rate of £10 per additional hour. If you intend to avail of this service, you should choose this option during the booking process.

8.4 A late return time will result in hirer being charged at the rate of £25 per hour. It is very important to give advance warning of any potential late return by phone asap as your insurance cover may expire before your journey is complete.

8.5 Hirers must arrive on time to collect the motorhome. Failure to do so may result in a delay to the start of your hire. We suggest 30 minutes for the handover on the day, on the basis that the handover videos have been watched.

8.6 All drivers need to be present on collection of the motorhome and must bring their full valid photo licence card or other ID as confirmed prior to collection.

8.7 Rent a Motorhome NI will make every effort to have your motorhome ready for the allocated collection time as agreed on the Rental Agreement. However, unforeseen circumstances may arise which are out of our control and mean that the motorhome will not be ready for the agreed time. We accept no liability for that. We will however endeavour to inform you at the earliest opportunity of any potential delays. Should this be the case, no refunds will be due to you, but we will seek to offer an extension of your hire for the time period lost, at no extra cost to you. Please note, that due to other bookings in the calendar, this may not always be feasible or possible.

8.8 If for any reason you are unable to make the handover period at the start of your hire, it may be necessary to arrange the handover and collection to a new time or day.

8.9 Please ensure that we have received all the necessary paperwork from you before you come to collect the motorhome. Should we fail to receive these prior to collection of the motorhome we reserve the right not to release it to you.

8.10 Rent a Motorhome NI will require the hirer to complete a handover prior to commencement of the hire. This may be done by video online. The videos will also be available to watch at anytime online. There is also a paper handbook in the motorhome for reference.

8.11 The hirer be required to sign to confirm that they have watched the videos and have been present for a handover.

8.12 Any consequential damage requiring repair caused as a result of user error by the hirer or someone in their party will be charged to the hirer. This will be deducted from the security deposit if funds are available or invoiced to the hirer for immediate payment.

8.13 Prior to collection, a vehicle inspection form will have been completed and any defects noted. These will be pointed out to the hirer during handover. Any damage will be agreed by both parties before commencement of use.

Returning your motorhome:

8.14 No refund is given for early return of the vehicle at the end of your use.

8.15 On return of the vehicle all hirers are to ensure the vehicle is clean and tidy throughout. The chemical toilet needs to be emptied, clean and free from waste. Failure to empty and clean the toilet will result in an additional charge of £50.00 deductible from the security deposit.

8.16 There should be no vomit or other clinical waste in the vehicle. Should there be any such waste in the vehicle, the hirer agrees to pay for an independent cleaning company to clean the vehicle. This will be deducted from the security deposit if funds are available or invoiced to the hirer for immediate payment.

8.17 It is a breach of this agreement for the hirer to fail to return the motorhome at the end of the hire period. The damages payable for such a breach will be the commercial rental charges that need to be paid to provide a suitable vehicle to the other hirers for their use until the motorhome is recovered and in a suitable condition for their use. This is in addition to any costs incurred to recover the motorhome and return it to a suitable condition. In addition, the hirer shall fully indemnify Rent a Motorhome NI in respect of any claims for loss (including legal fees) brought against Rent a Motorhome NI by any third parties arising out of or as a result of the hirer’s failure to return the motorhome at the end of the hire period.

8.18 Any charges as detailed above will be deducted from the security deposit if funds are available or invoiced to the hirer for immediate payment.

9. Vehicle acceptance

9.1 You acknowledge having received the motorhome in a clean condition and in sound working order in accordance with the Motorhome Handover Checklist and with a full diesel tank, 1 x part full and 1 x full LPG gas bottle and part full fresh water tank.

9.2 You acknowledge that Rent a Motorhome NI will not refund to you any monies if the motorhome is returned early, or you cease to have use of the motorhome prior to the return date for any reason e.g. accident, weather, theft or damage.

10. Change of Vehicle

10.1 If the motorhome is unavailable for the agreed period, Rent a Motorhome NI will endeavour to find a suitable replacement motorhome of similar standard and size and offer this as a replacement option. However, this may not always be possible and therefore we reserve the right to cancel the booking and refund all monies (including the deposit) to the hirer. Such substitution shall not entitle you to any refund and does not constitute a breach of This Agreement.

10.2 Should the Customer decide to not to accept the replacement offer, then the hirer is entitled to a full refund (including the deposit).

11. Lost property

11.1 It is the hirers responsibility to make sure that upon return of the motorhome all of their personal possessions and rubbish are removed from the motorhome.

11.2 Rent a Motorhome NI cannot be held responsible should an item be left in the Motorhome.

11.3 Rent a Motorhome NI will do our upmost to contact the hirer if items are left behind, found by our cleaning staff or handed in by the next hirer.

11.4 Where possible we will return items by post and may require postage costs to be covered.

11.5 Items will be stored awaiting collection by the customer for two weeks before disposal or sending to a charitable cause, unless otherwise arranged.

12. Rental and Other Charges

You will pay Rent a Motorhome NI:

12.1 All rental charges.

12.2 The Security Deposit (see Section 14 for full details)

12.3 Administration fee of £25.00 per penalty charge notice received.

12.4 The valeting fee and /or upholstery cleaning fee if the vehicle is not returned with the interior in a clean condition.

12.5 The additional fee of £50.00 if the toilet cassette tank is not emptied prior to the return of the Vehicle.

12.6 The cost of refilling the diesel tank to full, plus an additional fee of £25.

12.7 The late fee should the vehicle be returned after the agreed time as stated on the Rental Agreement: £25 per hour until 6pm on the last day of the hire and then the daily rate after this.

12.8 The nominated cancellation fee as per the cancellation policy (as set out in Section 4) in the event of cancellation of this Agreement prior to acceptance of the Vehicle.

12.9 The cost of any damage to the vehicle or third-party property, subject to the insurance.

12.10 The insurance excess should there be damage involving third party property or the theft of the vehicle. This applies in respect of each claim, not hire.

12.11 All government fees and duties etc.

12.12 All parking fines, speeding fines, other fines or penalties and associated administration costs incurred in relation to the vehicle during the Rental Period.

12.13 Subject to the terms of This Agreement, you will pay for the cost of repairing or replacing tyres damaged during the Rental Period. Rent a Motorhome NI will reimburse you for expenditure reasonably incurred if:

12.13.1 The tyre is defective and is returned by you to us for inspection; and

12.13.2 You produce relevant receipts; and

12.13.3 The manufacturer accepts liability under the warranty

12.14 You will be liable for any costs associated with allowing the engine oil, coolant or windscreen wash to run empty and cause damage to the vehicle’s engine or normal function.

12.15 You will be liable for any costs associated with the incorrect use of fuel. The Chausson C656 motorhome runs on DIESEL.

12.16 Any other fees or charges payable by you pursuant to This Agreement. This includes any costs incurred by Rent a Motorhome NI as a result of any breach by you of the terms of This Agreement.

12.17 Any additional costs over and above the Security Deposit value should damages exceed the Security Deposit value.

12.18 The cost to recover a Vehicle.

12.19 In the case of gross negligence Rent a Motorhome NI reserves the right to recover full costs in order to return the motorhome to the state in which it was handed over.

12.20 Any call out charges necessitated by the client through operator error, e.g. a flat vehicle battery, wrong or insufficient fuel, keys locked in a motorhome, stuck in mud/sand

13. Errors in Rental Charges

13.1 Should it become clear that there has been an error in rental charges and you have been overcharged for your hire, you will receive a refund totalling the amount of the overcharge.

14. Security Deposit

14.1 There is a refundable £1000 Security Deposit to cover the Insurance excess or any damage caused to the vehicle and/or its contents. This is payable by credit card or debit card and the card should be in the lead driver’s name. There are two options for payment – either pay the £1000 in full or by holding it as an open security payment.

14.2 Pre-paid currency cards cannot be accepted.

14.3 Cheque payments are not accepted against the Security Deposit.

14.4 The security deposit is to be paid no later than 7 days prior to collection of the motorhome. If the security deposit is not paid by this time, the booking will be cancelled, and the fees as set out in Section 4 on cancellation fees will apply.

14.5 You irrevocably authorise Rent a Motorhome NI to deduct from the Security Deposit any amounts due by you to Rent a Motorhome NI for returning the motorhome in an unsatisfactory condition i.e. in a way that is set out in This Agreement in Section 8.

14.6 In the event that Rent a Motorhome NI elects to accept payment of the Security Deposit by holding an open security payment; a pre-authorisation for the full security amount will be processed and authorised by the Customer.

14.7 The Security Deposit will be refunded within 7 working days if it was paid out by the customer. If the customer opted for an open security payment rather than paying it out, it will be automatically released by our bank once the Vehicle has been returned to us as per the criteria set out in Section 8, ‘Vehicle Collection and Return’ and as long as there are no outstanding issues or insurance claims.

14.8 The Security Deposit will not be refunded on return of the motorhome.

14.9 Should any damages or costs exceed the Security Deposit the Customer will be responsible to settle all additional costs over and above the Security Deposit value within 7 days of being notified of the cost.

14.10 In the event of a Road traffic accident (RTA) or collision, the customer should be aware that the Security Deposit will be used to fund any loss or damage whatsoever to Living Equipment, fixtures and fittings, windows, valeting or upholstery fees, refuelling costs or negligent damage to the Vehicle. Should these damages exceed the Security Deposit held, the Customer will be liable for the total cost and the difference will be invoiced to the Hirer for payment. Any deductions from the Security Deposit will be advised by email to the lead driver / hirer.

14.11 Rent a Motorhome NI will manage the rectification of any damage. The hirer should contact Rent a Motorhome NI to seek instructions and authorisation BEFORE carrying out any repair. Failing this, an amount will be deducted from the deposit against damages for the cost of the repairs.

15. Use of the Vehicle

15.1 You agree that during the Rental Period, you will not, and will not allow the Vehicle to be:

15.1.1 Driven otherwise than in a cautious, prudent and normal manner

15.1.2 Used in a manner which could cause damage

15.1.3 Driven in a prohibited area or in an area

15.1.4 Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law

15.1.5 Left open whilst the Vehicle is unoccupied

15.1.6 Left with the ignition key in the Vehicle while it is unoccupied

15.1.7 Left unoccupied without the TV/DVD out and on display

15.1.8 Driven by persons under the age of 25 years

15.1.9 Driven by persons aged 76 or over, without prior confirmation from Rent a Motorhome NI

15.1.10 Driven by persons who are not authorised by law to drive the/any Vehicle.

15.1.11 Damaged by submersion in water

15.1.12 In contact with Salt Water

15.1.13 Used for any illegal purpose for any race, rally or contest

15.1.14 Used to tow any Vehicle or trailer

15.1.15 Used to carry passengers or property for hire or reward

15.1.16 Used to carry more persons than is permitted (Chausson C656 has 7 belted seats)

15.1.17 Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material

15.1.18 Otherwise used in breach of my obligations under This Agreement

16. Alterations to the Vehicle

16.1 You shall not make any alterations or additions to the Vehicle.

17. Title to Vehicle

17.1 You acknowledge that Rent a Motorhome NI retains title to the Vehicle and its contents and that you possess the goods as a mere bailee only.

17.2 You do not have any right to pledge Rent a Motorhome NI credit in connection with the Vehicle and agree not to do so.

17.3 You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle.

18. Smoking and Illegal Drugs

18.1 Rent a Motorhome NI operates a STRICT NO SMOKING and ILLEGAL DRUGS policy in our motorhome which includes the use of vapes, e-cigarettes, and illegal substances, such as Cannabis.

18.2 You must not smoke in the vehicle or directly outside the vehicle where smoke and smells may enter the vehicle.

18.3 Rent a Motorhome NI reserves the right to impose additional Valeting and or Upholstery cleaning fees should there be evidence of drug use, a smell of smoke or smell of Cannabis detected in the motorhome upon return. This fee will be deducted for the Security Deposit.

19. Passengers

19.1 Rent a Motorhome NI authorises the use of our motorhome up to the stated number of passengers (Chausson C656 is a 7 birth motorhome)

19.2 Each person is to wear a seatbelt at all times whilst the Vehicle is in motion. It is the responsibility of the driver to ensure all legal requirements are met and Rent a Motorhome NI will not be responsible for any charges or penalty points a driver receives for passengers not wearing a seatbelt.

19.4 Carrying more than the specified number of passengers is against the law and in breach of This Agreement.

19.5 Child seats are available (see Section 5, ‘Optional Extras with Charges’) and it is the responsibility of the hirer to fit them themselves. It is the responsibility of the hirer to ensure that all children are appropriately belted and secure. For clarity, the UK law states that children up to 12 years of age or 135cm in height, which ever they reach first, must use the correct child restraints appropriate for their weight/height. It is the responsibility of the driver to ensure all legal requirements are met and Rent a Motorhome NI will not be responsible for any charges or penalty points a driver receives for not ensuring a child is using the correct seat.

20. Pets

20.1 Rent a Motorhome NI operates at strict NO PETS policy.

20.2 Rent a Motorhome NI reserves the right to impose additional Valeting and or Upholstery cleaning fees should there be evidence of pets or animals detected in the motorhome upon return. This fee will be deducted from the Security Deposit.

21. Drivers

21.1 Only persons named on the Rental Agreement at time of hire may drive the vehicle.

21.2 Identity documents need to be submitted via email to booking@rentamotorhomeni.co.uk for checking no later than 48 hours prior to collection of the motorhome.

21.3 These will include:

21.3.1 Photo driving licence

21.3.2 DVLA licence check online (UK residents only). We are unable to insure you if we have not DVLA checked your licence details

21.3.3 1 x utility bill dated within 90 days of your holiday start date

21.3.4 1 x second proof of address (utility bill, landline phone bill) also dated within 90 days of your holiday start date. A list of acceptable documentation is provided.

21.4 If you are unable to provide the documentation detailed above, we may be unable to insure you to drive.

21.5 If no photo driving licence is available, we will require the paper version PLUS a valid passport as photo ID.

21.6 Your licence address must be your current home address. If not, then in addition to this, we will require either a utility bill or bank statement which has your name and current address listed.

21.7 All drivers whose licences are issued outside of the EU or Commonwealth are required to supply a valid International driving permit alongside your standard licence at the start of hire. This must be issued in the country your standard licence was issued and must confirm you are able to drive a UK category B Vehicle up to 3500kg GVM.

21.8 Should any driver fail to present all the correct documentation and identification on collection of the motorhome or do not meet the driver requirements stated in the terms and conditions, then Rent a Motorhome NI will be unable to release the motorhome and no refunds will be given.

21.9 Endorsements on licences: you must declare at the time of Booking if there are any endorsements on your licence. Rent a Motorhome NI can accept up to 6 speeding points that occurred within the last 3 years.

21.10 For drivers with more than 6 points or for any conviction other than for speeding, including, but not limited to the following codes: AC, BA, CD, DD, DR, IN, LC, MS, UT, MR and TT or for any driver disqualification within the last 5 years Rent a Motorhome NI may not be able to get cover.

21.11 No refund will be given if the hire is cancelled because we are unable to insure you to drive. It is the responsibility of the hirer to check eligibility to drive before booking.

21.12 ID is uploaded by the customer to our secure system and will be retained for 7 years for the purpose of, but not limited to the defence of any legal claim(s).

21.13 In an emergency situation, drivers may be added during the holiday, but only after contacting Rent a Motorhome NI and paying a £50.00 administration fee per driver addition. Identity documents must be supplied for additional drivers.

21.14 Drivers must be over the age of 25 and under 76 and held a valid driving license for at least two years.

21.15 Age groups outside this bracket may be insured with an additional premium and the supply of insurance cover will at our insurer’s discretion.

21.16 Driving licenses with endorsements maybe subject to a surcharge. Endorsements must be declared, and any additional insurance premium due must be paid before any use of the motorhome at any time during the term of this contract.

21.17 Drivers are personally liable for all legal penalties (e.g.: parking tickets, toll charges, congestion charges, speeding fines) which are incurred during the period of hire.

22. Insurance

22.1 Comprehensive insurance is provided for the motorhome included within the hire charge and the limitations to the cover are defined in the insurance policy schedule.

22.2 Rent a Motorhome NI needs to be informed in advance if additional drivers are required, so cover can be arranged no later than 2 days before departure. We will need to see their identity documents at least 2 days before they collect the vehicle and an Additional Driver fee for £40 will apply. This needs to be paid prior to collection of the vehicle.

22.3 The hire insurance does not include any personal insurance for the Customer (including death or bodily injury to the driver).

22.4 Personal effects and contents are NOT covered by our insurance. The hirer should cover such items separately and agrees to fully indemnify Rent a Motorhome NI from any loss or damage as a result of any issues with personal effects and contents.

22.5 Any additional premium to our insurance cover as a result of driver convictions or accidents will be passed on at cost to the hirer and will need to be paid in full as part of the overall hire fee before any use of the motorhome.

22.6 Only the named insured drivers can drive the motorhome.

22.7 You must declare at the time of Booking if you have made or had Vehicle insurance claim made against you within the last 5 years.

22.8 Rent a Motorhome NI may not be able to get cover should you have had 2 or more claims within the last 3 years.

22.9 Driver occupations: You must declare your occupation on collection of the Vehicle.

22.10 Rent a Motorhome NI may not be able to offer cover for the following occupations:

Celebrities

Sports personalities

Musicians

Entertainers

Serving Foreign Armed services personal

Embassy employees based in the UK

Students under the age of 30

22.11 Should the driver not disclose that they fulfil one of the above occupations even in a part time capacity, this will render the agreement as void and the hirer will be fully liable.

22.12 Rent a Motorhome NI is unable to insure any driver with no fixed abode.

22.13 In the event of the theft of the Vehicle, the hirer will be liable for the full cost of the Vehicle; once a theft has been reported to both Rent a Motorhome NI and the police, a claim will be lodged with the insurer. The keys must be returned to Rent a Motorhome NI.

22.14 Should the insurer accept the claim and agrees to reimburse Rent a Motorhome NI for the cost of the Vehicle, the liability to the hirer will reduce to the first £1000 of the claim (Security Deposit excess).

22.15 Please note: if the keys are not returned to Rent a Motorhome NI, the insurer will not accept the claim and liability for the full cost of the Vehicle will remain with the hirer.

22.16 No insurance cover is offered for Overhead Damage. Any damage deemed as gross negligence, including internal damage to the motorhome is the responsibility of the driver. Therefore, the driver accepts full liability for these. This is in addition to the standard Vehicle excess.

22.17 Any damage to tyres and any theft or loss of personal effects is not covered by our insurance and shall be at the hirers expense and, if required, in addition to the security deposit.

22.18 Rent a Motorhome NI will not be responsible for any loss which is a side effect of the main loss e.g., loss of profits or opportunity. This is separate from the Vehicle insurance provided.

23. Vehicle Damage – Insurance Cover

You are aware that:

23.1 The Vehicle is insured for damage to the Vehicle and the property of a third party; but does not include any personal insurance for the Customer or their possessions.

23.2 Insurance does not cover Overhead Damage. The hirer will be responsible for the cost to repair all overhead damages.

23.3 You will have to pay an excess for any Insurance claim regardless of which party is at fault for the accident. The insurance excess is £1000 per claim, not per rental.

23.4 You will not have any insurance cover and you will be responsible for the total cost of any damage if you breach any of the terms of This Agreement.

23.5 You will be responsible for any damage caused through gross negligence and will not be covered by the insurance.

24. Responsibility when accident occurs

24.1 In the event of any accident, loss or damage arising out of the use of the Vehicle, you will:

24.1.1 Notify Rent a Motorhome NI within 24 hours of the event happening.

24.1.2 Obtain the names and addresses of third parties and any witnesses, report the event to the nearest police station and get a police incident number. For clarity, the PSNI guidance on when to report following a road traffic collision is as follows:

Reportable:

When damage is caused to anything other than the vehicle or its contents (including another vehicle, property boundaries or street furniture such as lamp posts or street signs) or when injury is caused to anyone other than the driver of the vehicle or any animal not in or on the vehicle. An animal is defined by law as a horse, cattle, ass, mule, sheep, pig, goat or dog.

Non-Reportable:

When damage is only caused to the vehicle involved or injury is limited to the driver involved or any animal carried in or on the vehicle. (PSNI website, January 2024)

24.1.3 Complete an accident report in writing.

24.1.4 If the accident occurs in Europe, then in addition you must complete the European accident report form as supplied.

24.1.5 Not make any admission of liability to other parties, settlement offer or other like offer.

24.1.6 Assist Rent a Motorhome NI in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence.

24.2 You acknowledge that the excess or other amount due by you in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the Rental Period, regardless of which party is at fault.

24.3 You will pay for any costs relating to the delivery of a change over Vehicle or recovery vehicle as a result of an accident regardless of which party is at fault.

24.4 No Security Deposit or insurance excess will be refunded until any claim is settled.

25. Breakdowns and Accidents

25.1 Rent a Motorhome NI will supply full breakdown cover to cover any mechanical faults to the base chassis of the motorhome.

25.2 Any call out charges necessitated by the client through operator error, e.g., a flat Vehicle battery, wrong or insufficient fuel, keys locked in a motorhome etc, will be the responsibility of the hirer.

25.3 In the event of the motorhome being mis fuelled, the hirer is responsible for costs from the breakdown service, any subsequent repair costs to get the motorhome working correctly. These will be deducted from the security deposit if funds are available or charged to the hirer, plus a £25 administration fee for immediate payment.

25.4 You are authorised to spend up to £50 on necessary repairs and we will reimburse you against a valid VAT receipt.

25.5 Any repairs above £50 need to be authorised by a Rent a Motorhome NI via e-mail, text/Whatsapp message or phone call.

25.6 Any breakdown, malfunction or damage caused by the hirer’s negligence will be made good at the hirer’s expense.

25.7 Every effort is made to ensure the vehicle is in a roadworthy and safe condition before every hire. Therefore, The Rent a Motorhome NI absolves itself of any responsibility for hotel or any other consequential expenses subsequent to a breakdown. This does not extend to death or personal injury.

25.8 The maximum height and length of your vehicle is clearly stated on the windscreen. Any damage as a result of mistaking those dimensions is the responsibility of the hirer. This includes, but is not limited to, driving under a height restriction. Such repairs will be deducted from the security deposit if funds are available or charged to the hirer plus a £25 administration fee for immediate payment.

25.9 In the event of loss of keys please call Rent a Motorhome NI immediately. Do not attempt to gain entry into the motorhome using force or by causing damage such as breaking a window to gain entry. A charge of £150 will be levied for the loss of any keys to the motorhome.

25.10 No responsibility is accepted by Rent a Motorhome NI for any loss or consequential loss or damage or expense which occurs as a result of any accident. In the event of an accident, the hirer must not admit responsibility.

25.11 The hirer should obtain the names and addresses of everyone involved, including witnesses. In additional the Hirer should make the motorhome secure, tell the police straight away if anyone is injured and contact Rent a Motorhome NI immediately via a phone call.

25.12 The Hirer must also produce an accident report and send a copy to Rent a Motorhome NI. We suggest you use a mobile phone or camera to photograph the accident, surrounding areas and anything that might prove useful after the accident.

26. Fuel, Gas and Water

26.1 Rent a Motorhome NI operates a strict full-to-full policy. A full tank of diesel is supplied with the vehicle at the commencement of the hire and we expect and require the tank to be returned full. A charge will apply returning the Vehicle without a full tank (see Section 12, ‘Rental and Other Charges’). Any such charge will be taken from the security deposit, should there be sufficient funds available, or an invoice raised to the hirer for immediate payment.

26.2 We check oil and windscreen wash and water levels prior to the motorhome’s collection, but for bookings longer than a week, it is the hirer’s responsibility to check and maintain oil, windscreen wash and water levels to vehicle specifications at least weekly.

26.3 Two gas cylinders will be supplied at commencement of hire: one part full and one full. It is the hirer’s responsibility to ensure that the gas connection is fitted correctly and is secure before operation. It is also the hirer’s responsibility to check that there are no leaks before igniting the gas inside the motorhome.

26.4 Any cylinders lost or incorrectly exchanged will be charged to the hirer at cost, plus a £10 fee.

26.5 You will be liable for any costs associated with the incorrect use of fuel or misfuelling. This includes putting fuel in the water tank or vice-versa. Our Chausson C656 runs on DIESEL.

26.6 Rent a Motorhome NI will not be held responsible should the hirer run out of diesel, gas or water during the hire.

27. Tracker & Speed Monitoring

27.1 I/we agree that Rent a Motorhome NI can use data collected by the onboard tracker to periodically monitor the location and speed of the vehicle as required by our insurers, and this action will not be considered to be a breach of personal privacy.

27.2 Travelling into a geo fence such as a Port or transit point will automatically trigger an email by the tracker to our email address. We will subsequently be in touch with the hirer to seek clarity on the whereabouts of the vehicle and advise accordingly.

27.3 Should an alert and/or the data from the tracker cause us to suspect that any term in Section 15 ‘Use of the Vehicle’ of this agreement is being breached, or the vehicle is suspected as being stolen, we will take swift, appropriate and reasonable action to recover our motorhome as soon as possible.

28. Credit and Debit Card Payment

28.1 Visa Card and Mastercard credit cards only. Pre-paid currency cards are accepted for payments but not for the Security Deposit.

28.2 When payment is paid by credit, debit or pre-paid currency card, you agree that:

28.2.1 Rent a Motorhome NI is irrevocably authorised to complete any documentation and to take any other action to recover from my credit or debit card issuer all amounts due by you pursuant to This Agreement, including but not limited to those outlined in Section 12, ‘Rental and Other Charges’.

28.2.2 You will not dispute your liability to Rent a Motorhome NI for any amount due under This Agreement and you shall indemnify and keep Rent a Motorhome NI indemnified against any loss incurred (including legal costs) by reason of notifying your credit or debit card issuer of such dispute.

28.2.3 Rent a Motorhome NI may process the credit or debit card voucher; in the event that Rent a Motorhome NI elects to accept payment of the Security Deposit by holding an open security payment, which will be cancelled 7 days after the completion of the Rental Period, as per Section 14, ‘Security Deposit’, you agree that Rent a Motorhome NI is entitled to recover payment from your credit or debit card issuer pursuant to Sections 28.2,28.2.1 and 28.2.2 of This Agreement in respect of any amounts due which were not known at the time of cancelling the open security payment.

28.3 You acknowledge that all transactions under This Agreement are conducted in Pounds Sterling.

28.4 Due to exchange rate fluctuations, there could be some variance between the amount initially debited against your credit or debit card and the amount refunded within 7 days after the expiration of the Rental Period. You release Rent a Motorhome NI from any liability for such variation.

29. Payment of Charges, Joint and Several Liability

29.1 All charges and expenses payable by you under This Agreement are due on demand by Rent a Motorhome NI.

29.2 When the Customer comprises of more than one person, each person is liable jointly and severally for all obligations of the Customer pursuant to This Agreement.

30. Ending the Agreement

30.1 You acknowledge that Rent a Motorhome NI may terminate This Agreement and repossess the Vehicle at any time, without notification to me, and that you will pay the reasonable costs of repossessing the Vehicle, including towing charges if:

30.1.1 You are in breach of any term of This Agreement.

30.1.2 You have obtained the Vehicle through fraud or misrepresentation.

30.1.3 Any statement, representation or warranty made by you in respect to yourself or additional drivers is incorrect.

30.1.4 The Vehicle appears to be abandoned.

30.1.5 The Vehicle is not returned on the agreed return date or Rent a Motorhome NI reasonably believes that the Vehicle will not be returned on the agreed return date.

30.1.6 Rent a Motorhome NI considers on reasonable grounds that the safety of passengers or the condition of the Vehicle is in danger. You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges or the Security Deposit.

30.2 If the Hirer is an individual this agreement will terminate automatically in the event of the Hirer being declared bankrupt. Rent a Motorhome NI may terminate this agreement if the Hirer does not meet any of the conditions of this agreement.

30.3 If the Hirer is a company, this agreement will terminate automatically if the company goes into liquidation or calls a meeting of creditors.

30.4 Rent a Motorhome NI may terminate this agreement if the Hirer does not meet any of the conditions of this agreement.

30.5 Termination of this agreement shall not affect Rent a Motorhome NI’s right to receive any money owed under the conditions of this agreement.

30.6 Rent a Motorhome NI may also claim extra costs from the Hirer if the Hirer does not meet any of the conditions of this agreement.

31. Release and Indemnity of Rent a Motorhome NI

31.1 Subject to its obligation to deliver the Vehicle or an appropriate substitute Vehicle, you release Rent a Motorhome NI from any liability to you (regardless of who is at fault) for any loss or damage incurred by you by reason of This Agreement, including but not limited to:

31.1.1 Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for my purpose.

31.1.2 Any loss or damage to any property left in or on the Vehicle, in any service Vehicle or on Rent a Motorhome NI’s property or recovered or handled by Rent a Motorhome NI.

31.2 Subject to any insurance arrangements agreed with Rent a Motorhome NI, you hereby indemnify and shall keep indemnified Rent a Motorhome NI against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle.

32 Force Majeure

32.1 Rent a Motorhome NI will make every effort to ensure that our Motorhome is available for you at the correct time. If, due to circumstances beyond our control, this is not possible and if an alternative or acceptable Motorhome is not available, our liability is limited to the refunds of all monies paid by you.

33. My Warranties

33.1 You warrant that all information supplied by you to Rent a Motorhome NI in connection with This Agreement is true.

34. Proper Law

34.1 This Agreement shall be governed by UK law in which This Agreement was signed.

35. Data Protection

35.1 Your personal data and information that you have provided to Rent a Motorhome NI will be processed for the following purposes and in accordance with our Privacy Policy which can be found on our website www.rentamotorhomeni.co.uk/privacy-policy/

35.2 To fulfil this contract/ agreement placed with us, including but not limited to motorhome hire and production of the Rental agreement, your personal data including copies of all identification documents provided and all data entered in the Rental Agreement will be retained for 7 years for the purpose of, but not limited to the defence of any legal claim(s).

35.3 To fulfil our legal requirements as a Vehicle rental company.

35.4 We will not transfer your personal data to any third party outside Rent a Motorhome NI unless:

35.4.1 It is to book a third-party service for you including ferry crossing and taxi transfers.

35.5 It is for on-road Vehicle assistance for example Vehicle recovery/breakdown providers and repair workshops.

35.6 It is to our insurer.

35.7 It is to the police, local authorities, councils, DVA or DVLA if we suspect or are notified that a road traffic offence/ contravention has occurred.

35.8 It is to local authorities, councils and private parking companies if we suspect or are notified that you breached private parking terms and conditions, toll or congestion charges.

35.9 To insurance companies if we suspect or are notified of an incident with a third party.

35.10 It is to the police, DVA/DVLA and Customs and Port authorities if we suspect or are alerted to criminal activity.

35.11 Our bank or merchant provider in line with transactional processing.

35.12 You are in breach of our agreement in which case we may notify the police, our solicitors, debt collection agencies, credit reference agencies and any other relevant organisations.

35.13 The third party is our subcontractor or a member of our companies, who is processing personal data on our behalf securely and in accordance with our instructions.

35.14 It is between software systems that we use for the purpose of our business as a Vehicle rental company including but not limited to Anytime Booking and Global Telematics.

35.15 It is for feedback on our products and services provided.

35.16 You have submitted content, photos and/or videos to our social media channels or entered a competition that we have run. By doing so, you agree to the photo(s) you submit being posted to our website and social media platforms. We may also use it for posters and advertising and share it with our partners, wholesale and web-based agents for them to use for their own marketing purposes.

35.17 It is otherwise authorised under the Data Protection Act.

35.18 Rent a Motorhome NI may use your personal information for marketing purposes and to keep you informed by post, telephone, SMS, email or other electronic means about products and services which may be of interest to you.

35.19 We will only contact you if you have selected to hear about our services and offers by opting in and we will only use the contact methods that you have agreed to.

35.20 If at any point you would like to stop receiving information from us, you can click unsubscribe at the base of any email or send an email to info@rentamotorhomeni.co.uk and we will remove your name from the marketing database.

35.21 By entering into This Agreement, you agree that we can process and store your personal information in connection with This Agreement including data collected from the Vehicle which may include your location(s) from our Vehicle tracking system and also diagnostics (telematics). We may use your information to analyse statistics, for market research, credit control and to protect our assets.

35.22 You agree that if you break the terms of This Agreement, we can pass your personal information to any relevant organisation.

35.23 We agree to keep all personal information in a secure environment and to comply with GDPR regulations and our own privacy policy and any other applicable data protection legislation currently in force.

36. General

36.1 The hirer will ensure all hatches and doors are securely fastened during transit.

36.2 You must advise Rent a Motorhome NI within 12 hours of becoming aware of any fault with, or damage caused to the motorhome. This should be done by email, text/Whatsapp or a phone call.

36.3 You may not use the motorhome to tow any trailer or vehicle.

36.4 The Motorhome must not be driven in a manner which would render void the policy of insurance, or in contravention of any Road traffic Act or Construction and Use Regulations, or by any person who is not licensed to drive the Motorhome or who is under the influence of alcohol or drugs, nor must it be driven in the event of mechanical, electrical or structural failure if further damage may be caused. The Motorhome may not be used for any illegal purpose or for racing, pace making, testing the Motorhome’s reliability and speed or teaching someone to drive.

36.5 If the hirer commits any material breach of this agreement, Rent a Motorhome NI may treat the agreement as terminated and take possession of the motorhome.

37. Governing Law

37.1 This agreement is governed by the UK law, including Northern Ireland.

37.2 We reserve the right to vary rates and conditions at any time.

37.3 We reserve the right to refuse use to any person(s) for any reason and not hand over the vehicle if we feel the hirer is not suitable for any reason, we deem reasonable.

37.4 We reserve the right to repossess the vehicle at any time due to misuse, damage or accident or any reason whatsoever we deem reasonable.

38. Entire Agreement

38.1 This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of This Agreement.

38.2 Rent a Motorhome NI reserves the right to add or amend the Vehicle specifications and rental charges without prior notice.

38.3 This Agreement does not affect your statuary rights under civil law.

38.4 Upon signing the Rental Agreement, the hirer is legally deemed to have agreed and accepted these terms and conditions.
